Response to alleged UNC regulation violations

USAG-Humphreys  –   The United Nations Command is aware that unauthorized activities in the DMZ were permitted by a frontline division for civilian personnel on 20 December 2021 at OP 241 Baekgol. The UNC Commander has initiated an investigation into the incident to determine the root cause of failure and ensure there is neither a repetition of actions that undermine compliance with the terms of the Korean Armistice Agreement nor actions that put civilians under greater risk than is absolutely necessary.
 
Under Article 10 of the Armistice Agreement, the Commander of United Nations Command is responsible for “civil administration and relief” in the southern portion of the DMZ, and is required to closely control all access (including both “military and civilian”) into the DMZ for only essential activities in order to maintain a separation of forces and prevent a resumption of hostilities. Since 1953, UNC and the Korean People’s Army have made subsequent agreements to the original Armistice Agreement in order to promote common understanding across the DMZ of the purpose of personnel in the DMZ which included how both military and civilians are marked. Both sides agreed that combatants would wear distinctive markings which, for the UNC side, include camouflage uniforms and Military Police armbands.  All of these provisions from the Armistice Agreement and subsequent agreements are intended to prevent the resumption of hostilities and to protect the civilian visitors to the greatest extent possible.
 
UNC codified these requirements to ROK Army frontline units in our regulations, but also in specific DMZ access approval messages (including the one in question from 20 December), quarterly letters from the UNC Military Armistice Commission to the frontline divisions, frequent Armistice compliance inspections, and Armistice education sessions.
 
Unfortunately, on 20 December, a frontline division did not comply with these legal directives and placed civilians under greater threat than necessary by putting them in military uniforms (marking them as combatants), authorizing additional personnel into the DMZ without UNC approval, and allowing them access outside of specially designated and controlled areas designed to minimize the potential for threats to civilians. UNC designated 17 specific locations in the DMZ that are approved for civilian access under significant constraints with compliance delegated to the ROK Army frontline divisions.
 
UNC is investigating this matter to address root causes for non-compliance and, when the investigation is complete, will take actions as appropriate under the Armistice and standing agreements with the Republic of Korea government.
